Will Golhaabo ratify the constitutional amendments?

Last month Maldives Dictator Golhaabo said in one of his addresses that the ratification of the constitution will be the fastest process of all implying that he will do so quite swiftly. However, as time goes, we are noticing that he is not very keen on it and has obviously requested certain changes to be made, including immunity from prosecution. Now we are hearing that the election deadline might even be extended to allow Golhaabo to fiddle with the constitution. Whilst the opposition is fighting each other, Golhaabo is taking advantage and delaying the whole reform process. It could very well be that this year’s elections will have to be held under the existing constitution, get a majority of the nominations from the parliament and go for a public referendum. Only thing is, this time there will be a NO campaign against him.

ހައްދުންމަތީގެ ޞިއްހީ ދާއިރާގައި މަސައްކަތް ކުރައްވާ ސަރުކާރުގެ އެންމެހާ މުއައްޒަފުންނަށް މުސާރަ ދިނުމުގެ އެންމެހާ ޒިންމާ އަކާއި މަސްއޫލިއްޔަތު އަދާކުރަމުންދާ ތަނަކީ ހައްދުންމަތީ ގަމު ރީޖަނަލް ހޮސްޕިޓަލްއެވެ. މި ހޮސްޕިޓަލްގައި ގާތްގަނޑަކަށް 160 މުއައްޒަފުން މަސައްކަތް ކުރަމުން ދާއިރު އޭގެތެރޭގައި ބިދޭސީންނާއި ދިވެހި މުއައްޒަފުން މަސައްކަތްކުރެއެވެ. އިދާރީ މަސައްކަތް ކުރާނެ ގިނަ މުއައްޒަފުންތަކެއް ތިބުމާއިއެކު ޢާންމު ރައްޔިތުންގެ ލުއި ފަސޭހަޔަށްޓަކައި ޑިޕާރޓްމަންޓް އޮފް މެޑިކަލް ސާރވިސަސް އިން ހިންގަމުންގެންދާ ގިނަ މަސައްކަތްތައް ޑީސެންޓްރަލައިޒް ކުރުމުގެ ގޮތުން ލ. އަތޮޅުގެ ޞިއްޙީ ދާއިރާގެ އެންމެހާ މަސައްކަތްތައް ޒިންމާދާރުގޮތެއްގައި ކުރުމަށްޓަކައި ޙަޥާލުކޮށްފައިވަނީ ލ. ގަމު ރީޖަނަލް ހޮސްޕިޓަލްގެ ދެއުޅި އެއްނުވާ ރޯނުއެދުރު (ސެންސަރުކޮށްފައި) ޢަލީ ނާޞިރާއެވެ. ތަޢްލީމީގޮތުން އަންހެން ކުޅީގެ ރޮނގުން ޕީ.އެޗް.ޑީ ޙާޞިލްކުރައްވައިގެން ހުންނެވި ރަނގަޅަށް އިނގިރޭސި ބަހުން އަދި ކިއެއްތަ ދިވެހިބަހުން މުޢާމަލާތް ކުރަން ނުދަންނަ މަހާޗޯރުގެ އައުވާނު މި ބޮޑު ވަގު 2008 މެއި މަހުގެ 20 ހިސާބު ރަސްމީ ދަތުރެއްގައި ކަމަށް ހަދައިގެން އަނބި ގޮއްޔެ ގާތަށް ވަނީ މާލެ ގޮސްފައެވެ.
ހައްދުންމައްޗަކީ ޞިއްޙީ ދާއިރާގައި ގާތްގަނޑަކަށް 350 ހެއްހާ މުއައްޒަފުން މަސައްކަތް ކުރަމުންދާ އަތޮޅަކަށްވާއިރު، މި ހުރިހާ މުއައްޒަފުންނަށް ލިބެންވާ މުސާރަ މެއި 2008 ނިމުނުއިރު ލިބިފައި ނުވާކަމީ ކޮޅެތް ނެތްހާ ހިތާމަ ހުރިކަމެކެވެ. ނަމަވެސް މިކަމަކީ އަދި ކުރިޔަށް އޮތް ތަނުގައިވެސް ތަކުރާރު ވަމުންދާނެ މިކަމަށް އެއްވެސް ޙައްލެއް ނެތްކަމެއް ކަމާއި މެދަކު ޝައްކެތްނެތެވެ. ސަބަބަކީ މި ޢަލީ ނާޞިރަކީ ލ. މާބައިދޫ ބަންޑާރާގޭ އިބްރާހީމް ފުޅު ( އިބަ ) ގެ ހުރި ލ. ހުޅިމެންދޫގައި އެސް.ޓީ.އޯ. އިން ތެޔޮވިއްކި ދުވަސްވަރު އެތަނުގައި ތެލުގެ ވަށްކަން ކޮށްގެން ޢާއިލާ މުއްސަނދި ކޮށްދިން ވަގު ދަރި (ސެންސަރުކޮށްފައި) އިލްޔާސްގެ (ސެންސަރުކޮށްފައި) އިބަސުވާ މީންގެ ރަސްކަންފުޅުގެ ކުޑަކަލާންގެ ކަމުގައިވާތީއެވެ.
ރަސްމީ ދަތުރެއްގައި ކަމަށް ހަދައިގެން ސިވިލް ސާރވިސްގެ އެތައް ބަޔެއްގެ ޙައްޤުތަކަށް އަރައިގަނެގެން ނޫން ގޮތަކަށް އަނބި ފިރިކަންކުރެވޭ ކަމަށްވާނަމަ، ޒިންމާ އަދާ ނުކުރެވެނީ ކަމަށް ބަލައި ވަޒީފާއިން ވަކިނުވެ ހުންނަން މި ލުއްޗާއަށް ލަދުގަންނާކަށްވެސް ނޭނގޭތާ ހީކުރާނީ މިކުރެވުނީ ކިހާ މޮޅު ހައިބަތު ބޮޑު އާރާއި ބާރާއި ނުފޫޒު ބޭނުންކޮށްގެން ކުރި މޮޅުކަމެއްކަމުގައެވެ. ވާނިވެސް އެހެންތާއެވެ. (ސެންސަރުކޮށްފައި) އިލްޔާސް (ސެންސަރުކޮށްފައި) ޙައްޤު ނޫން ގޮތުގައި އެކަށީ ގެން ނުވާވަރުގެ މަޤާމުވަނީ ދީފައެވެ. މިގޮތުން ހެލްތް މިނސްޓަރަކަށް ރަން އަޑުގެ ވެރިޔާ ހުރިއިރު ތަކުރާރުކޮށް 2 ފަހަރުމަތީން ރައީސް އޮފީހުގައި ދަންނަވައިގެން މި (ސެންސަރުކޮށްފައި) ވަނީ ހޮސްޕިޓަލްގެ އެސިސްޓެންޓް މެނޭޖަރުކަން ދީފައެވެ. މި (ސެންސަރުކޮށްފައި) އަކީ އެފަދަ މަޤާމަކަށް އައުމަށް އެއްވެސް ގޮތަކަށް ޝަރުތު ހަމަނުވާ މީހަކަށްވާތީ ތަކުރާރުކޮށް ދެ ފަހަރު ދަންނަވައިގެން މަޤާމު ލިބުމުން މި (ސެންސަރުކޮށްފައި) ވަނީ ތިމަންނައަށްވުރެ ރީއްޗަށް ގޮވާ ހިމާރެއް ނެތް ކަމަށް ހެދިގެން އެހެން މީހުން ގައިން ދާ އޮހޮރުވާ ލައިގެން ކޮށްފައިވާ ބުރަމަސައްކަތުން ހޯދާފައިވާ އެންމެ ރަނގަޅަށް ހިންގި ހޮސްޕިޓަލުގެ އިނާމު ގަމު ރީޖަނަލް ހޮސްޕިޓަލްގައި ހުރެގެން (ސެންސަރުކޮށްފައި) މެދުވެރިވެގެން މައްމޫނު އަތުން ފޭރިގަނެފައެވެ. ތަޢްލީމީ ގޮތުން މިހާ ފުންނާބުއުސް އީ.ޕީ.އެސް. ސްކޫލް ގްރޭޑް 9 ން ފާސް ނުވެގެން ޓިއުޝަން ކްލާހަކަށް ދުވަސްކޮޅަކު ދިޔުމަށްފަހު ޖީ.ސީ.އީ. އޯލެވަލް އިމްތިޙާނުން ޔޫ ސެޓް ހޯދާފައިވާ މި ދެއުޅި އެއްނުވާ ދޯދިޔާ ދޯހަޅި ރޯނު އެދުރަކީ (ސެންސަރުކޮށްފައި) ބުނާގޮތުންނަމަ ޒަމާނުގެ ތަޢްލީމު އުނގެނިގެންހުރި ޖީ.ސީ.އީ. އޯލެވަލް ހަދާފައިވާ ރާއްޖޭން ބޭރުން އެކި އެކި ކޯސްތައް ހަދާފައިވާ އަންހެން ކުޅީން އޮނަރަރީ ޑޮކްޓަރޭޓް ކަން ކިޔަވާ ވިދާޅުވެގެން ހުންނެވި ކަފޭރާ އެކެވެ.
މިނިސްޓްރީ އޮފް ހެލްތުން ޞިއްޙީ ދާއިރާގައި މަސައްކަތްކުރައްވާ ޓެކްނިކަލް މުއައްޒަފުންނަށް އަމާޒުކޮށްގެން ހަމަޖައްސާފައި ހުންނަ ކުރުމުއްދަތުގެ އެކިއެކި ބައްދަލުވުންތަކާއި ޓްރޭނިން ޕްރޮގްރާމްފަދަ ކުރުމުއްދަތު ( 3 ހަފުތާ ) ގެ ކޯހަކަށް (ސެންސަރުކުރެވިފައި) ތައިލެންޑަށް ފޮނުވުމުން އެއް ހޮޓަލުން (ސެންސަރުކުރެވިފައި) އަނެއް ހޮޓަލުން އަންހެނަކުގޮވައިގެން ވާހަކަ ދައްކަން ނޭނގި ގަނޑަ ތެޅިފައި އައުމުން (ސެންސަރުކުރެވިފައި) މިވަރުގެ ދެބޯގެރިއަކު ނެތެވެ. އެކަމަކު ކުރާނީ ކީއްހެއްޔެވެ. މިހާރު މިއީ ޑެޕިޔުޓީ ޑިރެކްޓަރަކޯލައެވެ. ނުޙައްޤުން ވަޒީފާގެ ޑަބަލް ޕްރޮމޯޝަން ދީގެން ދިވެހި ސިވިލް ސާރވިސްގެ މަޤާމެއްގައި އެއްގޮތަކަށްވެސް އެމަޤާމުގެ ޝަރުޠު ހަމަނުވާ ގޮތުގައި ވަޒީފާގެ ވާޖިބާއި މަސްއޫލިއްޔަތު އަދާ ނުކުރެވޭ މިފަދަ ދަށު ދަރަޖައިގެ ނާޤާބިލް މީހުންނަށް ބޮޑެތި މަޤާމުތައް ދިނުމުން، ދެން ތިބި ސިވިލް ސާވިސްގެ މުއައްޒަފުންގެ ޙާލާއި މެދު ސިވިލް ސާރވިސް އިން ކަނު ލޮލަކުން ބައްލަވައިފިނަމަ ސިވިލް ސާރވިސް ކޮމިޝަނަށް އެބޭފުޅުންގެ މަސްއޫލިއްޔަތު އެއޮތީ އެންމެ ފުރިހަމަޔަށް އަދާކުރެވިފައެވެ.
ސިވިލް ސާރވިސް ކޮމިޝަންގެ ޢިއްޒަތްތެރި ކޮމިޝަނަރ ޑޮކްޓަރ ލަޠީފްއެވެ. މިދެންނެވި ޢަލީ ނާޞިރުގެ ސަބަބުން ލ. އަތޮޅު ޞިއްޙީ ދާއިރާގައި މަސައްކަތް ކުރައްވާ އެންމެހާ މުއައްޒަފުންނަށް 2008 ވަނަ އަހަރުގެ މެއި މަހުގެ މުސާރަ އެމަސް ހުސްވެގެން ދިޔައިރުވެސް ލިބޭނެގޮތް މި ނާގާބިލް ޢަލީ ނާޞިރުގެ ސަބަބުން މެދުވެރި ވެފައިވާކަމީ ސިވިލް ސާރވިސްގެ އެތައް ބައިވަރު މުއައްޒަފުން ތަކެއްގެ ޙައްޤަށް އިޙްމާލުވުން ނޫން ކަމުގައި ވާނެތޯއެވެ. އެހެންވީއިރު މިފަދަ އެންމެ މީހެއްގެ ސަބަބުން އަޅުގަނޑުމެންނަށް ލިބެންވާ ޙައްޤުތައް ނުލިބި ދިޔުމުން މަނިކުފާނު މިކަމުގައި ޒިންމާ ދާރުވާންޖެހެއެވެ. މިއީ ކަނޑައެޅި ހާމަކަން ބޮޑުގޮތުގައި ފެންނަން އޮތް ޙަޤީގަތަކަށް ވާއިރު މިކަމުންވެސް އެނގެނީ މި ޢަލީ ނާޞިރަކީ އެފަދަ މަޤާމެއްގައި ހުންނެވުމަށް އެކަށީގެން ނުވާ ޤާބިލް ނޫން މީހެއްކަމެވެ. ވީމާ، މީނާ އަށް ވަޒީފާގެ ވާޖިބާއި މަސްއޫލިއްޔަތު އަދާ ނުކުރެވޭ ކަމަށް ބައްލަވައި އެމަޤާމުން ދުރުކުރުން ނުވަތަ އޭނާއަށް ވާޖިބާއި މަސްއޫލިއްޔަތު އަދާކުރެވޭ ވަރުގެ އޭނާއާއި އެކަށީގެންވާ ދަށުދަރަޖައިގެ މަޤާމަކަށް ޑިމޯޓް ކުރައްވަންވީ ނޫންތޯއެވެ.
ޙައްޤުގެ މައްޗައް ބާޠިލް ގަދަވެގެންވާ މި ސަރުކާރުން ވަކިބައިގަނޑަކަށް މި ޞިއްޙީ ދާއިރާއިން 2008 އޭޕްރިލް މަހުގެ ފަހުކޮޅުގައި ދެއްވާފައިވާ ޑަބަލް ޓްރިޕްލް ޕްރޮމޯޝަން ތަކުގެ ސަބަބުން މިދާއިރާ ބޮއްސުންލައި ގޮސްފައިވާއިރު މައުމޫނަށް (ސެންސަރުކުރެވިފައި)ގެ ބޮޑު (ސެންސަރުކުރެވިފައި) ނޫނީ މިޞިއްޙި ދާއިރާގައި ބަހަށްޓަން ނުފެންނަކަމީ އެމަނިކުފާނުގެ ދުރުވިސްނުމުން މިޞިއްޙި ދާއިރާވެސް ބޮއްސުން ދުއަވާލުމަށްޓަކައި އަޅުއްވާފައިވާ ވަރަށް ހެޔޮފާލެއްކަމުގައި ނޫނީ ނުވާނެއެވެ. އެމަނިކުފާނަކީ މިހާރު މުސްކުޅިވުމުގެ ސަބަބުން އެމްނީސިއާ ޖެހިވަޑައިގެންފައިވާ ނިއުރޯންގެ މައްސަލަ ހުންނަ ބޭފުޅެއްކަން ވެރިކަމުގެ ދަހިވެތި ކަމުގައި ޤަބޫލުފުޅު ނުކުރެއްވޭ ބޭފުޅެކެވެ. މިއީ ޤަބޫލުފުޅު ނުކުރެއްވިޔަސް ޢުމުރުން ދުވަސް ވުމުގެ ސަބަބުން އިންސާނާގެ ޠަބީޢަތަށް ކުރިމަތިނުވެ ނުދާނެ ޤުދުރަތުން ހަމަޖައްސަވާފައިވާ ކަމެކެވެ. މިކަންކަން ޤަބޫލު ނުކުރެއްވޭނަމަ އެއްކައުވަންތަ ކަމަށް ދަޢްޥާ ކުރުމަކީ ފަހެ ކޮބައިހެއްޔެވެ.
ހައްދުންމަތީ ގަމު ރީޖަނަލް ހޮސްޕިޓަލް ބޮއްސުންލައި އެތަނުން ފަރުވާ ހޯދަން އަންނަ ފަރާތްތަކާއި މެދު އެތަނުގެ މުއައްޒަފުންގެ އަޅާލުމާއި އެހީތެރިކަން ކުޑަވެ، ޚިދުމަތް ހޯދަން އަންނަ ބަލިމީހުންނަށް ތަނުން ދެމުންގެންދާ ޚިދުމަތް ފޯރުކޮށްދިނުމުގައި ފަރުވާ ކުޑަކޮށް ބޮލާ ލައި ޖަހާގޮތް ވަމުން ދާތާ މިހާރު އެތަކެއް ދުވަސް ވެއްޖެއެވެ. ނަމަވެސް މިކަން ކަން ރަނގަޅުކުރުމުގެ ގޮތުން މި ޢަލީ ނާޞިރަށް ކުރެވުނީ ކޮން ކަމެއްތޯއެވެ. މީނާއަށް ކުރެވޭނީ ފަހެ ކޮން ކަމެއްތޯއެވެ. ބިދޭސީންގެ އަތްމައްޗަށް ހުރިހައި ކަމެއް ދޫކޮށްލައިގެން އެމީހުން ހިތުހުރި ގޮތަކަށް މަސައްކަތުން ރެކެން ބޮލުން ނަށްޓާލުމުގެ ގޮތުން ކިތަންމެ ކުޑަކަމެއްގައި ބަލިމީހަކު ހޮސްޕިޓަލަށް ދިޔަކަމުގައިވިޔަސް މާބޮޑުކަމެއްގެ ގޮތުގައި ދައްކައި ބަލިމިހާއާއި އެހީތެރީން ޕްރެޝަރަށް ދުއްވާލުމުން އެންމެ ފަހުން ބަލިމީހާ ޖެހެނީ ތެޅި ފޮޅިގަނެގެން
އެކި ފަރާތްތަކުގައި ސަލާން ޖަހައި ދަރަނިވެރި ވެގެން މާލެ ދާށެވެ. މާލެ ގޮސް އައި. ޖީ އެމް އެޗްގެ ޑޮކްޓަރުންނަށް ދެއްކުމުން ބުނަނީ އެއްވެސް މައްސަލައެއް ނެތްކަމާއި ތިޔަ ކަމުގައި މާލެ އައުމުގެ ބޭނުމެއްވެސް ނެތްކަމުގައެވެ.
ގަމު ރީޖަނަލް ހޮސްޕިޓަލްގައި މަސައްކަތްކުރާ ދިވެހި މުއައްޒަފުންގެ ދަށުވެގެން (ސެންސަރުކުރެވިފައި) ކުޅެމުން ގެންދާ މި ލައްވީއަކީ އެތަނުގައި ބަސް ނުވިކޭ އޮޑިއެއްގެ ދިރުނބާ ކޮޅުގައި ހުންނަ މާލިމީ އަކަށް ވުމުގެ އިތުރުން ލަގަން ދޫކޮށްލައްވައިގެން ހުންނަ މަރުމޯލެކެވެ. ޞިއްޙީ ދާއިރާގެ ޓެކްނިކަލް އެއްވެސް މަޢްލޫމާތެއް ލިބިފައި ނުވާތާ ތަޢްލީމީ ގޮތުން އެއްވެސް ބުރަދަނެއް ނެތް މި (ސެންސަރުކުރެވިފައި) ބަލިމީހުންނަށް ޞިއްޙީ މަޢްލޫމާތު ރޯނުބައިކޮށް ދެމުންގެންދިއުމުގެ ސަބަބުން ތަންދޮރު ނޭނގޭ މީހުން އެވަރުގެ މޮޅު މީހަކު ނެތްކަމަށް ދެކިގެން އުޅޭ ބަޔަކުވެސް އުޅެއެވެ. އެކަމަކު ހެޔޮވާނީ ކިހިނެއް ހެއްޔެވެ. ޞިއްޙީ މަޢްލޫމާތު ބަލިމީހުންނަށް ދޭން މީނާ އަކީ ކާކުހެއްޔެވެ. މެޑިކަލް ޓާރމިނޮލޮޖީން ޕީ.އެޗް.ޑީ ހައްދަވައިގެން ހުރި އެންމެ ދަށް މިނުން ދިވެހި ބަހުން މުޢާމަލާތް ކުރަން ނުދަންނަ އަންހެން ވެރީންގެ ޕެޓަރާޅު ފޫދުއްވަމުން ރޭގަނޑުގެ ވަގުތުތަށް ހޭދަކުރާ މި ބޮޑުވަގު މިހާރު ކުރާކަމަކީ ހޮސްޕިޓަލުގެ ބަޖެޓް ޤަޥާޢިދާ ޚިލާފަށް ބަނޑު އަޅަމުން ދިޔުމެވެ.
މިކަމުގެ ވަރަށް ފުރިހަމަ ހެއްކާއި ޤަރީނާ ވަރަށް ފުރިހަމަޔަށް ފެންނަން އަދި ލިބެން އެބަހުއްޓެވެ.
ނަމަވެސް ކެވޭނީ ކާންދީގެންނޭ ބުނާ އުޞޫލުން ގަމު ރީޖަނަލް ހޮސްޕިޓަލުގެ މިލިއަން މިލިއަނުގެ ބަޖެޓް ޤަޥާޢިދާ ޚިލާފަށް (ސެންސަރުކުރެވިފައި) ބަނޑުއަޅައި ހުސްކޮށްފިއެވެ.

Eviction notice for the Maldives Dictator

On Friday, Nepal’s government formally told the deposed monarch Gyanendra to vacate the royal palace within two weeks. The Nepalese TV is broadcasting video of trucks being driver from the palace to the deposed monarch’s private home and the government has setup a committee to audit palace property prior to nationalisation (read BBC report Eviction notice for Nepalese king).
Reading this piece of news, I just can’t help but wonder when it will our day in the Maldives. Surely, it will be wonderful to see the demented dictator Gayyoom being chased out of Theemuge – Riyaasee Ganduvaru and his stuff taken to the storerooms in Kimbigasdhoshuge. Perhaps, he can live temporarily at his in-laws. Anyway, unlike the Nepalese deposed king, I doubt if the Maldives public will agree to let the dictator live like a normal citizen without being tried in a court of law for all the crimes he had committed over the last 30 years. He must clear his name and that is near an impossible task considering the number of times he has unlawfully detained people and even killed. Furthermore, he must be tried for treason for undermining the constitution, Interesting times lie ahead.

President Requests Changes To New Constitution

As part of a final review of the constitution in progress, President Gayoom has requested seven key areas be addressed before the document is finalised by the Special Majlis (constitutional assembly) – including a request for some form of presidential immunity from prosecution.

The draft was completed earlier this month, but is now undergoing last-minute revisions before ratification by the president.

But legal reform minister Mohamed Anil has told local media the delay to the constitution will limit the number of new laws that can be passed before this year’s presidential election, the country’s first multi-party polls.

Presidential Immunity

One area of concern for the president is that of presidential immunity from prosecution. Immunity was proposed by the government’s Dhivehi Raiyyithunge Party (DRP) during the drafting process, but did not pass a Special Majlis vote.

Member of the drafting subcommittee Hassan Afeef said the proposal had failed to pass because, using wording similar to that in the current constitution, “it would have meant there was no way to bring him before a court of law.”

Therefore if the constitution was ratified in its current state, the president would be open to prosecution, according to Muiz.

The president now seeks a level of protection, but “not total immunity”, Muiz adds. And information minister Mohamed Nasheed says the president should have a level of immunity from civil suits and prosecution in discharging his official duty.

“If not it could lead to a situation where anyone with vested interests could stop the country from working,” he told Hamaroalhi.

Afeef said the subcommittee has drafted a clause to allow the postponement of prosecution until the end of office. “[A president] cannot be dragged to court all the time,” said Afeef.

But after the term ends, charges can be brought, with Afeef saying “there is no way he can be immune after he leaves office”.

Majlis

The subcommittee is also working to clarify the involvement of the Majlis (parliament) in decisions made by the executive, such as control of the military, proclamations and ratification of conventions.

The government has asked to limit the Majlis’ power to alter a proclamation made by the president, such as that of a national emergency, so that parliament cannot add new provisions.

Afeef, a member of the opposition Maldivian Democratic Party (MDP), supports this change. “The proclamations would limit the power of the people, so why should parliament want to increase that?” he said.

The government is also seeking to reduce the authority of the Majlis over security forces so the Majlis’ role does not clash with that of the executive.

And “mistakes” in the document will also be corrected, such as a clause saying proof in criminal cases should be “beyond all doubt” instead of the correct wording, “reasonable doubt”.

Citizenship

Earlier this month Robert Blake, US ambassador to Sri Lanka and Maldives, said a clause stipulating Maldivians had to be Muslims did not align with international conventions.

The constitution being drafted says Maldivians who are not of the Islamic faith will lose their citizenship.

Blake said the government told him they would look into the issue, but it has now been dropped.

Muiz said the reason the subcommittee had not addressed the matter was because the office of the attorney general (AGO) had failed to request any changes be made.

Afeef says the subcommittee has “left the issue for the main committee to decide” as it is a “controversial issue” that they did not want to broach.

State attorney Shameem said it had not been altered because of its “sensitive” nature, but mentioned the issue might even be taken to the new Supreme Court after ratification.

Revisions

Subcommittee chair Ahmed Muiz said President Gayoom had sent a letter to the speaker of the Special Majlis, Gasim Ibrahim, on 21 May highlighting ten key areas to address. Three such issues have since been dropped, leaving the seven as top priorities.

The subcommittee of the constitutional drafting committee is now working on solutions to over 200 issues raised by the government, including those identified by Gayoom.

On endorsement by the full drafting committee, the material will be passed to the Special Majlis (constitutional assembly) for debate and voting, before the whole document is sent to the president for ratification.

Information Minister Mohamed Nasheed told Hamaroalhihe believes the president’s concerns will “make it impossible” to ratify unless they are resolved.

Timeframe

The government has promised international diplomats the constitution will be finalised in time to set up independent commissions for this year’s presidential elections, but ongoing delays mean time is running short.

Legal reform minister Mohamed Anil told Miadhu the delays may affect legislation prior to elections, indicating certain laws may not have time to pass.

The initial deadline – set in 2004 as part of the government’s Roadmap for the Reform Agenda – for the new constitution was June 2007.

But now attorney general Azima Shukoor says the document will “hopefully” come into force in June 2008.

With government suggesting August 9th as a possible election date, parliament will have under two months to pass the laws necessary for independent commissions.

Judicial services and anti-corruption commissions are to be established within 60 days, meaning they may not come into being until after elections.

Notorious Gangster “Chika” Arrested In Malé

One of the Maldives’ most infamous gang leaders was arrested by police in possession of drugs, weapons and cash on Saturday morning in the capital, Malé.

Ibrahim Nafiz – nicknamed Chika – is a leader of one of the most well-known gangs in the capital, Buru, and is reported to have been involved for over ten years.

But many are questioning why he has been left free for so long, with former Foreign Minister Dr Shaheed claiming that the government have always known “exactly who is doing what” but have “shied away from acting in the past”.

Drugs Possession

Chika, 28, of Gaaf Dhaal Nadella, was apprehended at 2:40am on Saturday at his rented accommodation, following an operation by the Serious and Organised Crime Unit and Drugs Enforcement Unit of police.

He was found with 30 grams of suspected heroin, more than Rf 30,000 (US$2350) in cash, bank cheques and a 3 ft long sword, according to police media coordinator Sergeant Shiyam, who added that police “wanted to find evidence” when they captured him.

Gang-related violence in Malé has been on the rise, with at least three serious street attacks last week alone.

Chika is reportedly the leader of one of the main gangs in the city, and has been involved since he was a teenager in both fights and drugs, according to gang members.

When asked if Chika had been involved in many fights previously, Shiyam said “people suspect like that”, but would not comment further.

Untouchable

Police have been accused of not taking action against gang leaders in the past, and government has faced allegations that ministers are linked to certain gang networks.

Former Foreign Minister Dr Shaheed told Minivan News on Sunday that “pressure” on the government has caused them to act, after media and politicians had “highlighted links between street gangs and upper people in the government”.

“They have used these people for political purposes and so they [certain gang members] have had protection,” he alleged, adding they are only arrested when “government feels like they are not useful.”

Previously Minivan News has reported allegations from gang members they had been asked to sabotage political rallies held by the opposition Maldivian Democratic Party (MDP), with some admitting to fulfilling the request.

A former member of one of Malé’s gangs told Minivan News Chika had claimed many times that government couldn’t touch him.

“He’s king of Buru. Nobody can understand why he has been arrested. He had that much confidence,” the same individual said. “No-one knows what the game is around here any more.”

On Friday, former attorney general Hassan Saeed spoke out about the drugs issue, saying that government did not punish some offenders because they were “close to” people in the trade.

He cited incidents when he had made reports to police which were not acted upon, and named the Commissioner of Police as one source of the alleged corruption.

But police deny such rumours, saying only that most of the fights last year were “somehow linked with drugs”.

They say they are making more arrests and confiscating weapons to crack down on the street violence that appears to have escalated in recent months.

What Now?

Rumours of a revenge attack on police if Chika is not released have been circulating on the streets, although the truth of such stories remains to be seen.

Meanwhile, Shaheed said: “I would not be surprised if this government decision is a temporary aberration. Even if he is prosecuted, I’m sure a pardon won’t be far away.”

An associate from Chika’s gang, Buru, who claims to have been arrested “about sixty times” told Minivan News: “It is very bad. Everyone is shocked that this has happened. He’s never been captured before.”

Another member of Buru told a Minivan News reporter last year: “as long as this regime is in place, we [our group] will prevail.”

And Shaheed believes this move is only “temporary”. “Many political leaders feel they can depend on these street boys […] It [the government] is not going to kick the habit.”
